These Terms of Service ("Terms") govern your use of the SparkPay wallet application and related services ("SparkPay", the "Service"). By downloading, accessing, or using SparkPay, you agree to these Terms. If you do not agree, do not use the Service.
SparkPay is a self-custodial wallet. You alone control your assets through your key shares. SparkPay does not take custody of, hold, or control your funds, and cannot reverse, cancel, or recover transactions or lost credentials on your behalf.
You must be at least 18 years old and legally able to enter into these Terms. The Service is offered to users in the United States, and you agree to use it only where permitted by applicable law.
SparkPay lets you create and use a self-custodial multi-chain wallet secured by multi-party computation (MPC) threshold signing. Through the Service you can hold, send, and receive supported crypto assets, view balances and market data, swap tokens through independent third-party decentralized exchange aggregators, and connect to third-party decentralized applications (dApps) through the in-app browser.
Swaps, dApps, tokens, and blockchain networks accessed through SparkPay are operated by independent third parties. SparkPay does not issue, endorse, or guarantee any token or dApp, and does not control their prices, availability, or conduct. Your use of any third-party service is at your own risk and subject to that party's own terms.
SparkPay provides tools and information, not investment, legal, tax, or financial advice. Market and price data may be delayed or inaccurate. Crypto assets are volatile and you may lose the entire value of your holdings. You are responsible for your own decisions.
You agree not to use SparkPay for unlawful activity, including money laundering, terrorist financing, fraud, sanctions evasion, or any use prohibited by applicable law. You agree not to interfere with, attack, or attempt to gain unauthorized access to the Service.
Blockchain network fees apply to on-chain transactions and are paid to network validators, not to SparkPay. Certain features, such as token swaps, may include a service fee that is disclosed at the time of the transaction.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure against every threat.
To the maximum extent permitted by law, SparkPay and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of assets, profits, or data, arising from your use of or inability to use the Service.
We may modify or discontinue the Service, or update these Terms, at any time. Material changes will be reflected by the "Last updated" date above. Because SparkPay is self-custodial, you can continue to control your assets through your key shares independently of the app.
